The Company warrants the equipment against defects in material and workmanship for one (1) year from the date of shipment, provided operation is maintained within Class D service conditions, and will replace free of charge, F.O.B. its manufacturing plant, any part (other than wire rope or rope guide rings) found defective, provided the purchaser immediately informs the Company of the defect and no repairs or alterations have been performed by the purchaser or a third party without the Company's written approval; this warranty excludes normal wear and parts inherently subject to premature wear, and the Company is not responsible for phase reversal on the connected power station network, nor liable for damages caused by improper installation or use, lifting loads above rated capacity, or consequential damages, claims, expenditures, or losses arising from operational delays or work stoppages caused by defective equipment. All repairs during the warranty period must be authorized by the Company, and the warranty applies only if the purchaser provides a signed Equipment Certification Form certifying that the equipment has been properly installed, tested, and is in satisfactory working order; the warranty excludes damage caused by improper storage, installation, unauthorized repairs, misuse, improper wiring or electrical service, improper handling, overloading, unsuitable fuels or oils, improper modifications or maintenance, faulty construction or foundations, unsuitable building grounds, chemical/electro-chemical/electrical influences, or other circumstances beyond the Company's fault, and all warranties become null and void if the purchaser or any subsequent user engages in such improper conduct or if such circumstances occur, in which case the Company is free of all obligations, costs, and liabilities under the warranty. All warranties extend only to the purchaser in privity of contract with the Company, and the purchaser - not the Company - is solely responsible for informing equipment users of all warranty and liability limitations; except as stated, no express, implied, or statutory warranty is made by the Company, and the Company is free of any warranty obligations should the purchaser default on agreed payment terms.
