All products sold by Harrington Hoists, Inc. (HHI) are warranted to be free from defects in material and workmanship from the date of shipment, with coverage periods varying by product type - 1 year for electric and air powered hoists (excluding (N)ER2 and EQ/SEQ hoists), powered trolleys, powered Tiger Track jibs and gantries, crane components, below-the-hook devices, and spare/replacement parts; 2 years for manual hoists and trolleys and beam clamps; 3 years for (N)ER2 hoists, EQ/SEQ hoists, (T)EM/(T)SEM hoists, and RY hoists; 5 years for manual Tiger Track jibs and gantries and hoist motor brakes for EQ/SEQ, (T)EM/(T)SEM, and RY; and 10 years for the (N)ER2 brake and TNER hoist motor brake - provided the buyer notifies HHI in writing within sixty (60) days of discovering any alleged defect and the product has been used according to manufacturer recommendations without abuse, lack of maintenance, misuse, negligence, or unauthorized repairs or alterations. If HHI's inspection confirms a defect in material or workmanship within the applicable warranty period, HHI will, at its discretion, repair or replace the part or product free of charge (not including installation), with delivery made F.O.B. HHI's place of business for U.S. customers or FCA HHI's U.S. location for international customers under Incoterms 2010; no warranty claim will be honored without valid proof of purchase, the customer must obtain a Return Goods Authorization before shipping the product freight-prepaid along with an explanation of the complaint, repaired products remain covered for the rest of the original warranty period, replacement parts installed after the original warranty period carry only a one-year replacement warranty (not including installation) from installation, and if no defect is found or the defect falls outside the warranty's scope, the customer is responsible for return shipping costs. HHI disclaims all other express or implied warranties, including merchantability or fitness for a particular purpose, and will not be liable for death, personal injury, property damage, or incidental, contingent, special, or consequential damages, losses, or expenses arising from the use or misuse of its products, regardless of whether such damage results from any act or failure to act by HHI, whether negligent, willful, or otherwise.
